1. GENERAL:

1.1  Welcome to the www.babycomfort.co.uk Terms & Conditions of use. By using our online shopping service available on our website you agree to our Terms and Conditions. If you disagree with any part of these terms and conditions, please do not use our online store

2. ACCEPTANCE OF ORDER AND CONTRACT:

2.1  All orders placed are subject to confirmation and acceptance by us. The contract in respect of the products supplied by us to you comes into existence when your order has been accepted by us. For the avoidance of doubt, receipt of an order via our site does not constitute acceptance of an order. We reserve a right not to accept your order in some circumstances.

3. CANCELLATION/ RETURNS:

3.1  You have the right to cancel your order with us at any time within 7 days from the day after the date of delivery. In the event of the cancellation, you will not have to pay for any goods and any amounts you have been charged will be repaid to you by your original payment method within thirty days.
3.2  However, if you notify us that you wish to cancel your order after the order/item was sent/ posted/ shipped to you, which is normally the same day (if ordered before 3pm) after acceptance by us, then return postage will be at your cost.
3.3  Returned goods must be in original condition and including all original packaging. For the avoidance of doubt, the goods returned must not be unpacked or used, except:
3.3.1  when goods were originally damaged or you can demonstrate that the goods did not meet the description we made of them or were not otherwise suitable given the information you provided us with, and this was not possible to identify without opening the packaging. It does not cover change of mind.

4. DAMAGED OR OTHERWISE UNUSABLE GOODS:

4.1  We extend cancellation period to 30 days from the day after the date of delivery only if:
Goods you receive from us are damaged or you can demonstrate that the goods did not meet the description we made of them or are not otherwise suitable given the information you provided us with.
This section does not apply if damage is at your fault.

5. DELIVERY

5.1  We take great care packaging every item to ensure safe shipment to you. Once your order has been processed and we have received cleared payment, your item will be dispatched as soon as possible (usually the same day if ordered before 3pm).
We aim to deliver within 48 hours of receiving your order subject to cleared funds having been received however please allow 5 to 7 working days for delivery.

Next Day Delivery is not available to the postcodes below. All next day deliveries to postcodes the below we will process with our standard delivery option:

All orders are subject to stock availability at the time of shipping. Baby Comfort reserves the rights to not to accept and cancel your order in some circumstances.

 

UK AND THE REPUBLIC OF IRELAND DELIVERY IS A "DOOR-TO-DOOR" SERVICE.

5.2  If no one is at home when Interlink or DPD attempts delivery they will attempt delivery to a neighbour in the local vicinity and leave your parcel with them. If you do not want your parcel left with a neighbour please either leave a signed note explaining where the order may be left, the driver will then take your note as authorisation and the goods will be left where you have requested. This however is done at your own risk. Alternatively please use the re-arrange service via your e-mail or mobile. If these options are not possible the courier will leave a calling card and usually attempt re-delivery the following working, with exception of Royal Mail couriers. After this you will be required to collect the goods from your local depot or sorting office. Clear details of this will be on the 'sorry we missed you' card that will be left by your driver.

If the delivery address refuse delivery and the goods have not been cancelled under "Your right to cancel" (above) or if you do not respond to the "sorry we missed you" card left by your driver, your order will be returned to the sender (Baby Comfort) we will then wait for you to contact us before we refund you your money minus the return postage cost.

"Our Courier will strive to get your order to you in accordance with the delivery option you selected but, due to circumstances out of ours and our courier's control, i.e. extreme weather conditions, unforeseen incidents, mis-route of a parcel, delays may occur. Please be assured we will endeavour to get your parcel to you as quickly as possible."

5.3   Please note: We recommend all returns are arranged through Baby Comfort chosen courier service (Interlink, DPD), which provides a reliable and fully insured service. Interlink Express' returns charges are £12.50 up to 10 kilos and 50p per kilo thereafter, direct delivery charges may vary. Alternatively if you prefer to arrange your own courier (once your return has been authorised).

"Small bedding accessories (i.e. cover, sheets, blankets and duvets) can be returned by Royal Mail, but only once return authorisation has been obtained."

5.4   Please note: If you are ordering large items, you will be required to carry the objects into your house. Please ensure there will be someone at home who will be able to do this.
Big items such as cot beds & nursing chairs may require additional assistance when being delivered due to the size of the packaging.

Failure to enter the correct delivery details may result in a charge to amend these with Interlink Express

5.6   When receiving your delivery, if you believe the goods may be damaged, please ensure you sign 'damaged' with the courier.

6. WRONG DELIVERY ADDRESS IMPUTED:

If you provide us with a wrong delivery address and your goods are signed for by another party, we cannot be held responsible for any loss you incur as a result.

7. PRODUCT GUARANTEE:

7.1

  • Manufacturers guarantee will apply and vary.
  • It is your responsibility to properly follow instructions for use and wash care of products.
  • The guarantee is available to the original purchaser only when accompanied with the original receipt. Guarantee is not transferable.
  • The guarantee applies to the product only and does not cover any consequential losses – i.e. time or other products.
  • The guarantee applies to material and manufacturing defects only under normal domestic use in the United Kingdom.
  • The guarantee does not cover faults caused by factors outside the manufacturers control, including failure to follow the user guide and maintenance instructions, normal wear and tear, inappropriate use such as a single buggy being used for two children or the use of any make of toddler board, accidental willful and or misuse of the product, inappropriate storage methods and or inappropriate cleaning, modification, alteration, transformation of the product.
  • The guarantee does not cover parts subject to normal wear and tear, foam handles, rubber elements of wheels, pneumatic tyres, signs of fabric wear.
  • The guarantee does not cover pushchair accessories including bottle bags, cosy toes, foot muffs, pushchair liners, changing bags, rain covers, canopies, mosquito nets, parasols, head huggers, and neck supports.

7.2 Moving parts should be maintained on a regular basis and a lubricant such as silicone spray should be applied to keep necessary parts running smoothly.
7.3 Fabric accessories may fade at different rates especially when not being used together.
7.4 If a claim is made under this guarantee and the defect is not due to faulty materials or manufacture, Baby Comfort reserves the right to charge the customer a £35.00 fee to cover the engineers time and couriers costs or replacement parts supplied.

8. ANTI FRAUD MEASURES - PROTECTING OUR CUSTOMERS:

“We do not store credit card details nor do we share customer details with any 3rd parties” To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
